Terms of use

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind it to these Terms. The Service is an alpha experiment in collective intelligence: a panel of AI voices and a human network help you think through multiple-choice questions and open-ended dialogue. It is offered for reflection and informational purposes only.

You are responsible for your account, your login credentials, and all activity that occurs under your account. Keep your credentials secure and notify us promptly of any unauthorized use. Accounts are personal to you; do not share, sell, or transfer your account. We may refuse, reclaim, or reassign handles at our discretion.

You agree not to, and not to permit anyone else to:

harass, threaten, defame, or abuse others; post hateful, illegal, sexually exploitative, or otherwise harmful content; impersonate anyone or misrepresent your affiliation; dox or attempt to deanonymize other users; spam, scrape, or use bots or automated means against the Service; reverse-engineer, decompile, or attempt to extract source code or models; interfere with or overload the Service or its infrastructure; manipulate questions, answers, or accuracy marks for off-platform gain or to deceive; circumvent rate limits, quotas, or access controls; upload malware; or infringe anyone’s intellectual property, privacy, or other rights. We may remove content and suspend or terminate accounts that violate these Terms, at our sole discretion and without notice.

You retain ownership of the questions, answers, dialogues, and other content you submit (“User Content”). You grant HivePsyche a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for formatting), display, and distribute your User Content as needed to operate, improve, secure, and promote the Service — including showing public questions and answers to the network and creating aggregated or de-identified data. You represent that you have all rights necessary to submit your User Content and that it does not violate these Terms or any law or third-party right. You are solely responsible for your User Content.

Responses from the AI panel, the human network, and dialogue features are generated by language models and other users. They may be inaccurate, incomplete, biased, offensive, or misleading. Do not rely on them for any material decision. You use all output at your own risk, and you are responsible for independently verifying anything before acting on it. We make no representations or warranties about the accuracy or reliability of any output.

The Service is not intended for, and must not be used for, medical, health, financial, or investment purposes. Nothing produced on or through the Service — including AI panel responses, the distribution of human answers, dialogues, accuracy marks, or any other output — constitutes medical, health, financial, investment, tax, or legal advice provided by HivePsyche, and no such advice is given or implied. HivePsyche is not a medical provider, financial adviser, broker, or fiduciary, and no professional-client or doctor-patient relationship is created by your use of the Service. Always consult a qualified professional before making any medical or financial decision. You are solely responsible for your decisions and any consequences of them.

Paid tiers (Companion, Seeker, Oracle) are auto-renewable subscriptions; credit packs are one-time consumable purchases. On iOS, all purchases are processed by Apple through your Apple Account and are subject to Apple’s terms. Subscriptions automatically renew at the then-current price unless cancelled at least 24 hours before the end of the current period; manage or cancel anytime in Settings → your Apple Account → Subscriptions. We may change prices, features, or quota allowances on a prospective basis with notice where required; continued use after a change constitutes acceptance. Quota and credits have no cash value, are non-transferable, and may expire or be forfeited on termination. Except where required by law, fees are non-refundable; refunds for App Store purchases are handled by Apple under Apple’s policies.

The Service, including its software, design, text, graphics, logos, and the HivePsyche name (excluding User Content), is owned by HivePsyche or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. No other rights are granted. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Service.

The Service relies on third parties — including Supabase (authentication, database, hosting), AI model providers (your question text is sent to them to generate responses), and payment processors (Apple). Your use may be subject to their terms, and we are not responsible for third-party services or their acts or omissions.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any output is accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

To the maximum extent permitted by law, HivePsyche and its owners, members, and operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or other intangible losses, arising out of or relating to the Service or these Terms, even if advised of the possibility. Our total aggregate liability for all claims will not exceed the greater of (a) the amounts you paid us in the 12 months before the event giving rise to the claim, or (b) US $50. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

You agree to indemnify, defend, and hold harmless HivePsyche and its owners, members, and operators from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

We may suspend or terminate your access to the Service at any time, with or without notice, including for any violation of these Terms or to protect the Service or other users. You may stop using the Service and delete your account at any time (in the app under Account → Delete account). Provisions that by their nature should survive — including Sections 4–11 and 13–14 — survive termination.

These Terms are governed by the laws of the District of Columbia and applicable U.S. federal law, without regard to conflict-of-laws rules.

Binding arbitration; class-action waiver. Except for claims that qualify for small-claims court, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration, administered under the rules of a recognized arbitration provider and governed by the Federal Arbitration Act, rather than in court. You and HivePsyche waive any right to a jury trial and to participate in a class, collective, or representative action. Arbitration will be seated in the District of Columbia or conducted remotely. If this arbitration provision is found unenforceable, disputes will be resolved exclusively in the state or federal courts located in the District of Columbia, and you consent to their jurisdiction and venue.

For apps obtained through the Apple App Store, the following also apply and, in case of conflict, control to the extent required by Apple:

These Terms are between you and HivePsyche only, not Apple, and Apple is not responsible for the app or its content. Your license to use the app is a non-transferable license to use it on Apple-branded products you own or control, as permitted by the App Store Terms of Service. Apple has no obligation to provide maintenance or support for the app. In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. HivePsyche, not Apple, is responsible for addressing any claims relating to the app, including product-liability, regulatory, and consumer- protection claims, and any third-party claim that the app infringes intellectual-property rights. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government prohibited-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

We may modify or discontinue the Service or update these Terms as the product evolves. Material changes will be posted here with an updated date and, where required, additional notice. Your continued use of the Service after changes take effect constitutes acceptance.

These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor or affiliate. Nothing here creates a partnership, agency, or employment relationship.
